I guess the officer didn't believe him when he said the CAR was driving.

well you cant be a major movie star unless you either get a dui or get pissed and beat up someones car with a golf club, or through a phone at someone

funny thing about this whole thing is they never gave him a breathalizer or any type of sobrity test. so im sure everything will get dropped or he will spend 15min in county jail like most every1 else with a big paycheck. but as far as celebs go hes not doing bad compared to some of the trash out there lol

Meh. I don't think it's necessarily that celebs feel untouchable. I think it's just people being people. It's just more high profile, because if you or I do something stupid, it's not on (inter)national TV 5 times a day.
I mean, the last time I checked, somewhere between 35 and over 50% of US males have been arrested!

In a televised interview with Access Hollywood airing today, Transformers 2 director Michael Bay claims his star, Shia LaBeouf, was not driving drunk Sunday morning when his Ford truck collided with another car and flipped onto its roof.
“You’re gonna see — that’s gonna go away,” Bay said. “That’s fresh news… He was not drunk. He was drinking hours and hours before.”
Bay adds that LaBeouf's hand injury, incurred in the crash, might be written into the movie's script.

But still, I mean the guy meets Transformers and finds out he's Indiana Jones's son and it goes right to his head.
Also who says things like "you're gonna see, etc. etc." Michael Bay is a goof.

now they are placing the blame on the other driver saying he ran a stop sign or a red light and caused the accident and they are trying to get the dui dropped because it was hours before when he had been drinking

Just because he had been drinking hours before doesn't mean he didn't have any alcohol in his system. The body does take time to get rid of the alcohol in the body and it all depends on how much he had been drinking, body composition, etc.
Alcohol is metabolized at the rate of .015 of blood alcohol concentration (BAC) every hour. If Shia had a very high BAC like .08, it would have taken at least six hours to get rid of it all.
